3.2          Liquid esters.     The liquid esters of 2, 4-D shall have the following characteristics.

3.2.1      Acid equivalent.               The product shall contain a minimum of two pounds of 2, 4-D equivalent per gallon of formulation at 68^oF (20^oC).

3.2.1.1   Acid equivalent determination. The quantity of 2, 4-D contained in the ester formulation shall be determined by AOAC method for 2, 4-dichlorophenoxyacetic acid.

3.2.2      Miscibility and emuilsifibility.      The formulation shall be a clear solution readily miscible with oil and emulsifiable with water. It shall contain the necessary solvents and carrying and emulsifying agents, such that the emulsion formed requires a minimum of agitation during the mixing and application period.

3.2.3      Other ingredients.           The oil carrier in the formulation shall not detract from the herbicidal activity of the active ingredient and offer maximum penetration and spread of the spray solution. The product shall remain free solid material when held a temperature of 25^oF (-3.8^oC) for a period of at least 5 consecutive 24 hour days.

4.            REGULATORY REQUIREMENTS

4.1          Registration and labeling.             The herbicide shall be registered and labeled in compliance with the Regulations for the Enforcement of the Federal Insecticide Fungicide and Rodenticide Act (40 CFR 162-180).

4.2          Recovered materials.     The offeror/contractor is encouraged to use recovered materials to the maximum extent practicable, in accordance with paragraph 23.403 of the Federal Acquisition Regulation (FAR).

5.            PRODUCT CONFORMANCE PROVISIONS

5.1          Acid Content.    The quantities of 2, 4-dichlorophenoxyacetic (2, 4-D) acid contained in the salt and ester formulations shall be determined by the latest AOAC methods.

5.2          Product Conformance.  The products provided shall meet the salient characteristics of this commercial item description, conform to the producer’s own drawings, specifications, standards, and quality assurance practices and be the same product offered in the commercial market. The government reserves the right to require proof of such conformance.

6.            PACKAGING.     Preservation, packing, and marking shall be as specified in the contract or order.
